Default Egg cc & Loan - where to start?

Hi - I'm a pensioner newbie and have a couple of questions before I make my first move on Egg.

I have an Egg cc and also an Egg Loan both taken out around 6 years ago. I'm paying the min amount on my cc and have a Default Notice on the Loan as I cancelled my dd and am now 2 months in arrears.

Do I go for both at the same time or focus on the loan first? Do I use the Subject Access Request (£10) or the £1 option?

Also where are the letter templates hiding please? I'm sure its obvious but....

Thanks for any help on offer.

PS Consolidated both loans ages ago - I think. Built up more debt on my card since.

your next move really depends on what you want to achieve. You could cca them (£1) but if you have consolidated quite recently you must be prepared for them to produce a valid cca

No, it was a few years ago (4+?) that I consolidated so I think (I hope) the cca wont be valid. I dont remember signing anything either. As I cant meet the payments for the foreseeable I want out of both debts.

So do you reckon I just go for the loan and leave the cc until later? Or can I pursue clearing both, separately, but at the same time?

It all depends on how much time you can spare to do it, many caggers are doing multiple disputes and I think they will be the first to agree that along with writing letters and researching the issues involved it can be very time consuming but still very enpowering. That said egg are pretty easy to deal with and soon pass you on to some pretty useless dca's.

I would get your cca requests off and see what comes back until you send a dispute letter on either account the fun doesn't start anyway you are entitled to use S77/78 at any time during the life of the agreement so there should be no adverse consequences in just asking for agreements.

when you send the cca reqests make sure you dont sign them. I have heard that some lenders are now refusing to comply without signature and id but when I sent mine in January I created a new signature especially for this purpose - none of them queried it even though it is nothing like my real/original signature! Or you can do as other caggers do and sign it but put a line through it so they cant lift it and use it on a fabricated cca

Also, if you stop paying you will get lots of calls- just tell them you only wish to communicate in writing. When I sent my cca rquests I also sent a letter to that effect and when they started ringing me I just said "please write to me, I will not discuss it on the phone" they will try very hard to engage you in conversaton - resist!! refuse to go through security with them too.

I did all 3 of mine at the same time ( 2 cards 1 loan) you will need to be organised

regarding signature - just sign it, put a line through it and put a highlighter through it.

Useful idea. Photocopy OK? Just noticed the new Egg address for all this (thank you Sticky). Glad I didnt get to the post yesterday.

Would it keep things clearer to send my cc and loan letters under separate cover or am I being too picky?

Just to give you a head start, ImStillStanding, I can understand Egg Card Agreement's and the reference to 'approved limit' as apposed to 'credit' or 'credit limit' etc., but can anyone tell me please why my Egg Loan agreement is unenforceable?

Am I right in thinking it's purely because the terms and conditions are not within the four 'corners' of the agreement?

Get yourself an account of photobucket as soon as you can and familirise yourself with it. Put all the paperwork you receive onto it, ensuring you delete all your personal information. And never ever, be afraid to ask, no matter how mundane you think your question is.

I haven’t been on here for quite a while. Despondent at Egg's replies and I’ve let things slide so now its getting more urgent.

I got the info I requested earlier:

My Egg card agreement is dated: 16.2.2005 but I am certain that the card was taken out much earlier than that. I haven’t been able to find any evidence to back this up however. My card account was terminated on 3 Aug 09.

My Egg loan agreement is dated: 7.9 2005 when I consolidated my loan and card debt with a new loan.
I had a solicitors letter on 22 June 09 re the loan but nothing has happened since then.

So now I need to know if there is anything further I can do in the circumstances. All I own is my car which isn’t worth much and I have a mild disability so living up a hill and frequently visiting my mum to help her care for my aunt who is seriously ill means that I need transport as they don’t live on a bus route.

All advice appreciated as ever.

Hi there!

As suggested in May Egg did sell my debt(s) on so I have heard from a number of collection agencies. Some of these were nasty and some very nice. I have politely but steadfastly refused to play ball. I just tell them the truth - I am a pensioner, I have no savings any more, I rent my flat and have sold everything I have of any value. Once they realise its a blood and stone situation they leave me alone - until the next one.

As nothing has happened apart from phone calls and letters I wonder if Egg sold me on because the agreement is unenforceable?

cc agreement uses word 'credit' Loan one says 'Personal Loan' (Egg photocopied too small and the docs came up as thumbnail size on the forum so arent posted here). I have them on photobucket if you want to take a look PM me.

As Egg are now out of the picture how do I proceed? Dont want this hanging over me for ever. Supposing I won the lottery?

Any help you can offer or any direction you can point me in to get more help would be greatly appreciated as is your time in reading and replying to this message.
