| Basic Account Holder | I took a loan from the Money Back Bank (A&L) in December '06 for £4700. I took the PPI by choice, in case I lost my job. I had the paperwork through and all was fine. December '08 I was made redundant (Merry Christmas!), and decided that I could not afford to live in the UK, so moved to Germany to be with my GF. I checked the paperwork I had for the PPI, and it said nothing about PPI claims from abroad, just claiming benefits. I went online, and found the same info.I moved to Germany and started to claim benefits, and finally got confirmation that I would get money in May (and you thought the dole office were slow in the UK!). I wrote to A&L when I was in receipt of benefits, asking for the PPI to pay the loan. I got a letter back from Genworth, the insurance company, telling me my claim had been disallowed, as I had not filled in an E303/1 form before I left the UK. I checked the paperwork I had, which was the Keypoints document, and there was no mention of this. Genworth told me it was in the T&C's document, something I never got. I have since written to A&L, asking for the CCA, the T&C's and to make a formal complaint. They have acknoledged this, but not responded, it has been three weeks now. I have not defaulted on payments, but will do next month, as I don't have the money to pay, any ideas about what I can do about it? I ant to pay the money I borrowed, but I took the PPI to cover me if I lost my job, and now they won't pay out. Bob. |

A&L have 40 calendar days to comply by issuing all the data applicable to you as a data subject. Are you aware A&L have been fined by the Financial Services Authority for mis-selling PPI. Here is a link... Alliance & Leicester to pay £7 million fine for PPI failings I would give them the 40 days if you get no responce issue a letter of non compliance of the requirements within the Data Protection Act 1998 also complain to the Information Commissioners Office and the FSA. Have a look in here for all the relevant information. PPI - Some Notes for Claimants.. links and this for the Subject Access Request if you have not yet sent one... Full SAR for ppi and one more Data Protection Act 1998 - Subject Access Request hope this helps you to get started on getting your PPI back. aa

| Basic Account Holder | I would rather the insurance paid out than getting the money back for the PPI. I took the insurance out in case of redundancy , and followed the rules according to the paperwork I had. I even checked before I left the UK, I looked on the A&L website about claims from abroad, all it said was 'receipt of benefits', nothing about completing forms. The link to the T&C's on the website takes you to a contact page, and not a copy of the T&C's.If I had known I cold of signed on for a few days in the UK, and then moved, and they would of paid. What are the chances of getting them to pay up under the insurance? if they refund the PPI I still have to pay the loan, and I can't afford to do that. |
