I took out a loan with Lombard in 2002 for £20,000. I believe that at that time I was mis-sold PPIautolinker.com autolinking image because I had a telephone conversation with them to the effect that I needed to take this insurance before they approved the loan. The PPI was £3814.21, making the total loan £23814.21 and then they added the charge for credit - £4523.19 making a grand total of £28337.40. I was making the payments up until early 2006, when I lost my job. I tried to make a claim but this was disallowed because I was sackedautolinker.com autolinking image. I have been struggling to make payments ever since and this debt has now been passed to Intrum Justitia who have been pursuing me for the last few years. They advise me that the debt is now £5,200, but I still believe that I am paying the PPI. I have now reached the stage where I have asked this company for a CCA, thanks to this site. What I now would like to do is try and pursue the PPI for being mis-sold. How do I begin this process?

Yes I do - it's a 2 page document, the second page lists the Credit Agreement Act 1974, the 1st page lists my personal details, the details of the loan and then a paragraph on Data Protection.

The first thing would be to write a letter of complaint to HSBCautolinker.com autolinking image, detailing your reasons for being mis-sold the PPIautolinker.com autolinking image. I am unable to post links here but, if you look at my thread in this section you will be able to copy/paste & amend the initial letter that i sent to them. The thread is titled - HSBC Loans/PPI & the last post made to it was on 25th August 2009 ( Page 28 ).

Once suitably amended, print your nameautolinker.com autolinking image ( Do Not Sign!! ) keep a copy for yourself & then send 1st class recorded

Well, I sent the request for CCA letter to Intrum Justicia and received a reply to the effect that they were passing the request back to Lombard. Today I received a letter from Lombard asking me to call them urgently regarding the CCA request. I don't want to call them and get into any conversations so should I just ignore this letter as they have not fulfilled my request or should I write again.

Advice is welcome.

They have 12 + 2 days to comply with your request for a CCA, if the time has passed write a letter before actionautolinker.com autolinking image ( Can be found in the templates libraryautolinker.com autolinking image ) I believe this states that they have not complied with your request for the CCA as per section 78 of the Consumer Credit Act & allows them a further 7 days to provide the CCA & then we shall take it from there. Also explain to them that you would like any communication by them to be by letter only! This will help you to keep a paper trail.

well its the failure to comply letter/ a/c indispute letter not the lbaautolinker.com autolinking image
you're not going to take any further action, so nothing to warn them about......but you can legally stop payments if you wish.

now the PPIautolinker.com autolinking image

you need to do a spreadsheet and charge 8% stat from the date of each PPI payment to the [date of your claim]
when you put your claim in
you also need to cancel the PPI.

if you want help doingthe spreadsheet you'll need to post up the agreement scan just remove all pers info but leave the figures.

Well before I have had a chance to send off the failure to comply letter, Lombard have sent yet another letter stating that the signatureautolinker.com autolinking image on my CCA request does not match their records. I didn't sign the letter as per instructions simply typed my name and did a squiggle. So where do I stand now, they are asking me to send another letter duly signed.

I did send the PPIautolinker.com autolinking image initial letter stating that I have been mis-sold but as yet have had no reply to this one. I sent it to the address as given me by Dec22 above.

It takes about 2 weeks for RBSautolinker.com autolinking image to acknowledge receipt of your complaint letter. I assume you sent it recorded so have you checked whether it has been delivered or not? If you want to ring them no is 0161 7556890.

I can't give advice on the signatureautolinker.com autolinking image issue as I signed my letters. Hopefully someone will come along and advise you of the next step to take regarding CCA and signature.

Thanks for all the info... Can someone please advise whether or not I should reply to the latest letter from Lombard asking me to sign and confirm both my address and signatureautolinker.com autolinking image. The letter basically says that once they have this confirmation they will pursue my request for CCA documents, but in fact Ihave been paying this debt to their DCAautolinker.com autolinking image for the past few years and they certainly have my address.

No news as yet from RBSautolinker.com autolinking image re PPIautolinker.com autolinking image, am waiting for a big fat cheque, ha.. ha..

Dear Sirs,

i refer to your letter of XXXXXXX in which you confirm that you are not sufficiently satisfied as to my identity to be able to send personal and financial information to me at this address unless i provide you with a

I have complied with your request and you will note that i have crossed my signature as an anit-tamper measure.

Until receipt of your letter in which you clearly raise concerns as to whether you are in communication with the correct person I have never been asked to supply a signature and yet your company has on a regular basis and over a great number of months (years) been sending personal and highly sensitive financial information to me at this address

Clearly , since you now admit that this was done without satisfactory proof of identity - then your letter is a clear admission to serious breaches of the Data Protection act

By copy of this letter I now make a formal complaint to the OFT and ask them to investigate your actions as soon as possible

I have been advised that there may be an alternative reason for your insistence on a signature, that being that you are perfectly well aware of my identity but are deliberately seeking to put obstacles in the way of my obtaining information rightly due to me under the Data Protection Act.

In either event it is right that the OFT should know of your actions. No doubt you need to admit to one or the other
