Angry Advise Please I have Been refused a claim for IPP with Barclaycard

Hi . I have received a reply off Barclaycard with reference to a letter sent to them to claim for a mis-sold PPIautolinker.com autolinking image . Its my belief i was sold it without being told I could get cover elsewhere if i wish ,also that it was in my best interests to take out the ppi alongside the credit card . This was July 1996 . I have paid thousands in ppi over the years .

July of 2009 I became unemployed through no fault of my own and made a claim to on my Barclaycarc ppi ,As I was out of work on Job Seekers allowance I felt that I could not afford to pay the ppi ,so I telephoned Barclaycard with regards to this ,at no point was I advised my claim would stop or that I could reduce the cover payments . The policy was cancelled by telephone . When finding out off my own back this claim had stopped I offered to backdate the ppi payments ,howver I was told Id have to claim again ,this meaning being already out of work I would not be entiltled to make a claim anyway .I have still beeen unsuccessful in finding work . The reply I recieved off Barclaycard Customer Realtions Dept is as follows

Further to your letter date <insert date of last correspondance > ( yet no date added in this and sent to me as typed above ) I am sorry you have had cause to complian about the Payment Protection Insurance policy provided by Barclaycard .

After reading your correspondance my understanding of your complaint is that you feel you were mis-sold the PPI Policy because the incorrect information was advised at the point of sale ,and therefore to resolve this matter you would like us to refund the PPI premiums you have paid on your card .

I have completed my investigation and would like to share my findings with you .

The PPI policy was applied to you account in July 1996,whereupon a policy document was forwarded to you directly by Barclaysautolinker.com autolinking image Insurance Dublin which provided full details of what was covered by this policy and what was excluded or restricted under the policy . It also gave details of how to cancel the policy within 30 days and obtain a full refund if it was felt the cover provided was not suitable for your needs .

From our records at Barclays Insurance Dublin we note that you were able to make a successful clainn in July 2009. In these circumstances it is clear that the policy was suitable and you benefited from our cover .

Having reviewed this matter I am satisfied the addition of PPI to your Barclaycard was carried out in accordance with our standard procedured . Any decision to take the plicy was made by you .Yopu were also provided with a period to which to cancel the policy for a full refund As a result I am unwilling to uphold your complaint

I trust this brings the matter to an end .

For the purpose of the Financial Ombudsmanautolinker.com autolinking image service you may regard this letter as our 'Final Response' yo your complaint .

Any advise would be appreciated .thanks

matters not that you made a claim, that will simply be deducted from the total they WILL be paying youback!.

the rest is std blurb they all put out to deter you from reclaiming.

i''ll get this thread moved to the PPIautolinker.com autolinking image forum.

if you look at the top of that forum in the stickie you will find sen thread named notes for claimants etc etc

read through those and off you go.

i would follow those guides and stick a reclaim into BC, inc a spreadsheet, then when they reply go off to the fosautolinker.com autolinking image.

it will help you if you read as much asmany threads as you can that way you will become aware of what to do and the tricks they will use

You shoud firstly read the stickies at the top of the forum.... then send a Subject access requestautolinker.com autolinking image see these links...

Data Protection Act 1998 - Subject Access Request

You can be specific with what data you request although the Subject Access Request is really asking for everything. The Statutory fee is £10.00 Postal Order is fine but keep the details of the number for future reference. The post office will be able to confirm when it was encashed (just call 01246 542091 they will even send written confirmation if you request it) Send all correspondence by at least recorded to be signed for so you can track delivery through Royal Mail

You should request the following documents:

A true copy of your Consumer Credit Agreement with the terms and conditionsautolinker.com autolinking image that were applicable at the time you took the loan/card/mortgage.

A ‘demands and needs’ questionnaire.

Copies of all statements applicable to the loan/card/mortgage.

Copies of all correspondence that apply to you as a data subject ie letters, emails, faxes etc.

Copies of all recorded telephone callsautolinker.com autolinking image or transcripts of the recordings.

Copies of any notes made by bank/loan company staff in their dealings with you as a data subject.

Do not be fobbed off by them citing issues such as relevant filing systems.

If they have any records/data on you as a data subject and it is held under your name, address, post code, account number/s or any other system where the data is identifiable to you then it is a relevant filing system. Even if it is a specific serial number on microfiche records and the serial number is applicable to you.
They have 40 days to respond in full then if no return a complaint to the Information Commissioners Officxe.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement

PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

Hi again
Well after receiving a final response from Barclaycard ,I decided to try another attempt to reclaim a mis sold PPIautolinker.com autolinking image with them before resorting to The Financial Ombusman .However I recieved a letter of reply off Barclaycard stating that I have had their final response and they would not deal with this .So off to the Financial Ombusman I went .I rang the fosautolinker.com autolinking image ,they were great ,took the information off me and sent me a form to fill in ,which wasnt a long .complicated fom .I have in the meantime also applied for a Subject access request off Barclaycard .Now awaiting response from The Ombudsmanautolinker.com autolinking image . I am definately not giving into Barclaycard
