    Default victim of identity fraud- retrieving paid money from the banks

    I need advise regarding credit card fraud from a legal perspective. I was impersonated and had a credit card taken out and used by my younger sister. At the time when i realised i had this outstanding debt i paid it off as my credit rating was being affected.(i am self employed). I then reported the matter as fraud to the bank and obtained the crime reference number they required to investigate, which they had hassled me to do before they would even look at the case. I was looking for Asda to return the money i had paid. i was then informed by Asda that they are closing the case and that i would have to sue my sister for the money as a civil, even though i reported the matter as criminal fraud to the police. I need to know if they are allowed to do this as it seems they have just washed their hands of the matter as they have the money. They informed me i had entered into a agreement when i paid the money in the first place, not sure what agreement this would be, (verbal)?
