    Default Voluntary termination, fair wear and tear?

    Hi im due to hand my car back to the finance company ( voluntary termination ) on 17th june and they have sent me a 3 page letter saying what the car must have

    My car is a 1999 mercedes 4x4 with 127k!

    For example

    No marks on wheels ( 127k on them there is scratches and corrosion )
    No marks on wing mirrors
    No damaged bodywork/rust/scratches!! ( its a merc they rust!!)
    car MUST have a stamped up to date service history ( done them myself )
    Must have valid tax ( non on when we bought it ) just ran out on sunday
    Must be insured on the day ( on my trade insurance but dont have a cover note stating the registration )
    If the mot had any advisories you must present that form, luckily it didnt have any but there is a chip on the screen that has been there for 2 years its not in the driver line of vision and it passed the last 2 mots with it but they say there musnt be any chips or cracks etc on the screen.

    along with a few other stupid things

    After speaking to the dealer where im getting my new car from he says its all bull...as long as its fair wear and tear thats it and they are just trying to scare me or take more money from me, they cant just introduce new rules to hand it back. He said to check out the FSA for what they say for VT but not having much luck

    can anyone help me?

    Take photos of all the areas and if you have a digital camera then take a hundred photos and put them on your computer.

    How many miles have you done in it?

    Does it say the service 'must' be carried out by a dealer? if not then you sign the book, get a stamp in Smiths if that's what they want.

    They will have to allow for fair wear and tear which isn't the same as damage.

    Why are you Vting if you are getting another, isn't the dealer interested in part exchange?

    I bought the car with 80k, now on 127k so have done 47k in it since sept 06
    The reason im VT is i owe about 4500 and its worth not even 2k? I offered to buy it off the finance company for what it will make in an auctionautolinker.com autolinking image but they said that if i want to keep it to keep up the payments.
    The company is park motor finance, i have to return the car to newport in wales. I have to return it to BCA where it will be checked and then they will just send it through an auction.
    As for the services it says the book must be stamped up to date, and if not they need the telephone number etc of the garage that has serviced it to verify it. Whole load of bull to me.....what if i bought the car with no or very little service history in the first place?
    The guy at the garage said they havn't got a leg to stand on, the finance agreement says that if i have paid 50% or more of the total amount, providing i have taken 'reasonable care' of the vehicle i dont have to pay any more. There should be a letter accompaniying the finance agreement saying if i wish to VT then these are the rules etc....
