IMO it is time to submit a complaint to the Financial Ombudsman Service as you seem to be being messed about by halifax.

Links that may help with your claim for Mis-sold PPIautolinker.com autolinking image
    Financial Ombudsman Service

    http://www.financial-ombudsman.org.u...-insurance.pdf

You should be sure to send copies of all correspondence sent and received so far. This will enable the ombudsman to at least have an idea on your side of the PPI issue. The fosautolinker.com autolinking image should then ask halifax to present its case and then the adjudicator or ombudsman will make a decision. You must be aware that the fosautolinker.com autolinking image are upholding about 90% of complaints so you should stand a good chance of success.

Make sure you speak to them first and in fact they will always call you back to save your phone bill. Give them as much information as possible and always keep spare copies of everything you send.

The fosautolinker.com autolinking image route takes time but the only cost will be your postage to the fos and any copying costs. It will however cost the halifax £500 for the FOS investigation.

You may even consider writing to halifax to let them know your intended actions.

Various views on this some say six years in line with the money laundering act but my own view is the banks probably/definately keep records for longer than this. However since the massive take off on reclaiming the banks and other institutions are trying to avoid massive mis-selling by saying anything beyond six years has been destroyed. This fails on the fact that if the account is still active they should still have all of the records and if the account is not active they should at least have the accounts from six years after the account was last active.

So account active up to 2004 should mean records available up to 2010 and to the exact month the account ceased to be active. I believe banks keep records much longer than this and are only now using the six year period to fight of the huge amounts of claims.

    Fight On

If you have all the copies of your consumer credit agreements then ask for a full refund of all PPI premiums you have paid and insist the refund is paid to you by way of a personal cheque. You are claiming back the PPI as mis-sold with the loan so any rebate/refund should NOT be used to pay off any arrears on the loan to the DCA.
