    Question General Q about MC process-

    In all of these MC cases, could somebody not force the bank into court (and thus set a precedent) by refusing to settle before the court hearing?

    Or is this just not allowed?

    The former being the case, it would be interesting to see what lengths the banks would go to to settle if you kep refusing to settle prior to an actual hearing?

    You cant refuse to settle, however you can make a request to the court that disclosure is made.

    However the risk here is that if you are seen to push the issue beyond a reasonable offer of settlement then you may become liable to a costs order.
