Default Carlyle Finance VT

I have been in touch with the above regarding a VT. Everything is up to date, I simply cannot sell the car and P/X is rubbish.

When I spoke to their Customer Services they confirmed I could VT, nothing was owing,there would be an inspection but they would have to mark my credit fileautolinker.com autolinking image with a V which would stop me getting any finance in the future??

Now am I missing something here, I am simply doing what the contract and the law says I can do, yet by doing so I will be penalised.

They cannot harm your credit rating because you are VTing a car. To exercise your right to VT the car when you have paid 50% or more is an acceptable term within your contract therefore you cannot be deemed to have done anything wrong. i have VTed a car before and have bought many cars on HP since with no concern being raised about my previous actions.

Maybe you should ask for clarification from them in writing as to what the imply they will do to your credit fileautolinker.com autolinking image and what they would consider the significance of their action to be. I can assure you that if they imply (in writing) that this entry if they make it, will harm your record, I think I would be advising them back that you will pursue the matter with legal action.

The saga continues, I have spoken to them again having now VT'd the car. What they are saying now that although an RAC inspection will take place this coming Friday, it could take 4 weeks before its collected I realised that this will take its past the date of its first MOT which is 7th March. I am assuming that as I VT'd the car then I am no longer responsible for getting this done?

What is also of concern is that I spoke with equifaxautolinker.com autolinking image, they confirmed in writing that Carlyle can enter a VT mark against my Credit File and it could affect my credit score, they have put that in writing to me, surely they too are acting against what the laws says.

Well an update, the car was taken back, Carlyle accepted I was within my rights and the vehicle was in good condition. I have now been informed by equifaxautolinker.com autolinking image that they have marked my Credit File with a caution and VT

Can they do that?

Have you since downloaded your Credit Report / Credit Score to see if it has harmed your Credit File in any way from equifaxautolinker.com autolinking image?

Never have a car on finance from Carlyle. My husband had a car on HP with them a few years ago. They kept taking 2-3 installments a month which was making us over drawn at the bank and stopped us from paying household bills. Every time we called them to say about the amounts they were taking they kept denying it until I started to send them the monthly bank statements.

I stopped the DD and started paying them over the phone with fund from another bank account. I left just over £1 more than needed for the actual monthly car payment so if the payment didnt auth I knew they were trying to take more than stated.

More than half way thru the term I had a man calling up demanding money and the car saying he was working on behalf of Carlyle Finance, the phone number he left for himself were a mobile number and a Birmingham Landline, which I called both and to our surprise 1- the mobile was a woman in her mid 20's and the other was to a Balti House in Erdington.

I called Carlyle straight away and my uncle who owns a bayliff firm for TV Licensing and asked his advise. He told me it was a criminal offence for someone to impersonate a Bayliff, so I sent a very detailed letter to Carlyle explaining this and that they had to sort out all the extra payments they took unauthorised from our bank account before anymore money was going to be paid on the account. I sent a copy of all letters to the MD of the company.
